近年來,圍繞新界「丁權」的「傳統權益」問題,香港社會時有爭論。所謂「丁權」,是指香港新界原居民的男性後人(即「男丁」),按殖民地時代沿用至今的「小型屋宇政策」(丁屋政策),獲准在新界的私人土地上興建房屋居住。《基本法》第四十條規定:「『新界』原居民的合法傳統權益受香港特別行政區的保護。」但對於何謂「新界原居民的合法傳統權益」,香港特別行政區應如何保護此類權益,《基本法》第四十條並沒有明示。因此,「丁權」的存廢爭議,焦點也就落在其是否《基本法》所指的新界原居民合法傳統權益之上。

「丁權」涉及新界原居民的利益和《基本法》的解釋,特區政府一直未敢妄動。本書作者特以此為主題,嘗試解釋《基本法》第四十條的學理、規範內涵,以釐清「合法傳統權益」的內容。書中提出了一系列的問題:「新界」和原居民由何而來?傳統權益包括哪些?《基本法》對原居民的權益作了何種保障?原居民權益是特權嗎?誰有權解釋《基本法》第四十條?適宜的解釋方法為何?「丁權」屬於合法傳統權益嗎?調整「丁屋政策」非修改《基本法》不可嗎?

「丁權」問題多年來已為特區政府造地及香港居民帶來困擾及不滿。作者透過回顧大量文獻,逐一解答以上問題,同時考察了《基本法》第四十條的起草過程和歷史背景,以探明立法原意,梳理了「新界」原居民權益可能面臨的憲制挑戰,冀能為此議題提供客觀、中立的法學研究,並嘗試探尋特區政府在其自治權限內調整此一「新界」政策的空間。對《基本法》及新界研究有興趣的人士,本書值得參考。
