This book explores the theory and practice of open access, including various mechanisms and models, such as Read and Publish agreements that are driving the movement forward.
Open Access in Theory and Practice investigates the theory-practice relationship in the domain of open access publication and dissemination of research outputs.
Drawing on detailed analysis of the literature and current practice in OA, as well as data collected in detailed interviews with practitioners, policymakers, and researchers, the book discusses what constitutes ‘theory’, and how the role of theory is perceived by both theorists and practitioners. Exploring the ways theory and practice have interacted in the development of OA, the authors discuss what this reveals about the nature of the OA phenomenon itself and the theory-practice relationship.
Open Access in Theory and Practice contributes to a better understanding of OA and, as such, should be of great interest to academics, researchers, and students working in the fields of information science, publishing studies, science communication, higher education policy, business, and economics. 近年來,圍繞新界「丁權」的「傳統權益」問題,香港社會時有爭論。所謂「丁權」,是指香港新界原居民的男性後人(即「男丁」),按殖民地時代沿用至今的「小型屋宇政策」(丁屋政策),獲准在新界的私人土地上興建房屋居住。《基本法》第四十條規定:「『新界』原居民的合法傳統權益受香港特別行政區的保護。」但對於何謂「新界原居民的合法傳統權益」,香港特別行政區應如何保護此類權益,《基本法》第四十條並沒有明示。因此,「丁權」的存廢爭議,焦點也就落在其是否《基本法》所指的新界原居民合法傳統權益之上。
「丁權」涉及新界原居民的利益和《基本法》的解釋,特區政府一直未敢妄動。本書作者特以此為主題,嘗試解釋《基本法》第四十條的學理、規範內涵,以釐清「合法傳統權益」的內容。書中提出了一系列的問題:「新界」和原居民由何而來?傳統權益包括哪些?《基本法》對原居民的權益作了何種保障?原居民權益是特權嗎?誰有權解釋《基本法》第四十條?適宜的解釋方法為何?「丁權」屬於合法傳統權益嗎?調整「丁屋政策」非修改《基本法》不可嗎?
